Summup Fintech Private Limited, is a company incorporated under laws of India with its registered office is at C3-124, Sobha City, Sector-108, Gurgaon, Haryana-122017, business Suprb division (hereinafter referred to as “SFPL”, "Company", “Us” or “We”). The Company is the owner of the mobile application under the name and style ‘Suprb’ and website : https://suprb.in/, (hereinafter collectively referred to as the "Platform" ). As a user ("User") of this Platform, the User understands that SFPL provides access to the Users to various financial products, including but not limited to, personal/consumer loans, credit cards, insurance products and credit insights and credit health reports etc., offered by the financial partners of SFPL or by SFPL in partnership with Credit Information Companies (“CICs”), with a view to facilitate lending and borrowing activities as well as financial health initiatives for the User. It is hereby clarified that the term "Users" or “You” or “Your” used under these Terms & Conditions shall mean and include any person accessing the Platform merely for browsing or for the purpose of availing product offered on the Platform. This document/agreement/understanding is an electronic record in terms of Information Technology Act, 2000 and is generated by a computer system and does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011. Your use of this Platform implies that You have read, understood and agreed to abide by following, disclaimer, terms & conditions ("Terms & Conditions"). These Terms & Conditions together with our privacy policy as provided on the Platform ("Privacy Policy") govern Your usage of the Platform and is a legally binding agreement between You, and the Company. The Terms & Conditions are governed by the provisions of the applicable Indian laws, the rules, regulations, guidelines, and clarifications framed thereunder, and the terms contained herein expressly supersede all prior agreements or arrangements between the Company and the Users in relation to the browsing or usage of the Platform. If You disagree with any part of these Terms & Conditions or the Privacy Policy, please do not use the Platform.
The Company reserves the right at any time, at its sole discretion, to change or otherwise modify the Terms & Conditions or to impose new conditions without prior notice, and Your continued access or use of the Platform signifies Your acceptance of the updated or modified Terms & Conditions. If you object to these Terms & Conditions or any subsequent modifications to these Terms & Conditions or become dissatisfied with the Platform in any way, Your only recourse is to immediately terminate use of the same without any liability to the Company.
You further understand that access to the Platform and the offer of any services is conditional upon Your irrevocable consent and acceptance of the terms contained herein (as may be amended from time to time).
1. General
The Platform provides the Users access to various financial products offered by the financial partners of the Company (“Lending Partners”). SFPL is merely a facilitator providing the Platform to any person in need of financial products and does not directly provide any financial services to the Users. SFPL is not an organization registered with the Reserve Bank of India or with the Insurance Regulatory and Development Authority of India and does not hold any license to engage in any activities relating to lending or borrowing or insurance distribution. SFPL is not a Financial Institution under the Companies Act, 2013 or the Banking Regulation Act, 1949 or any other laws for the time being in force in India. SFPL is also not a deposit taking company or a chit fund or a company offering any investment schemes as per the rules and regulations for the time being in force in India.
The Company is a service provider facilitating the provision of financial products from Lending Partners to individuals desirous of availing such financial products and provides credit health reports to Users, which are collated basis the credit information reports powered and prepared by CICs and information and explicit consent provided by the User (“Services”). Any Services offered on the Platform are subject to such terms and conditions as applicable and as may be notified from time to time or amended at any time without notice, by the Lending Partners or SFPL. The final decision as regards lending and borrowing and all other financial services is subject to the determination of the Lending Partners and is not determined by the Company.
The content (material, information, data, news items, texts, graphics, links etc.) (“Content”) contained on the Platform is provided for general information only and should not be used as a basis for making business/commercial decisions. You are advised to exercise due caution and/or seek independent advice before availing any facility or entering into any financial obligation based on the Content contained on the Platform.
The Content contained on the Platform or other terms are provided on an "as is", "as available" basis and are protected by copyright. You may not distribute the Content to others without the express written consent of the Company. You may not copy, download, publish, distribute or reproduce any of the Content contained on the Platform in any form without prior permission of the Company.
In the event You wish to avail any of the Services displayed on the Platform, You will be required to provide certain information and the Company representatives will contact You through phone or email to understand Your requirements.
2. Eligibility
The User of this Platform unequivocally declares and agrees that the User is a natural / legal person who has attained the age of at least 18 years and is legally allowed to enter into a contract in India. The User is allowed to utilize the Services of the Company in accordance with the terms and conditions detailed under these Terms & Conditions. If the User violates any of these Terms & Conditions, or otherwise violates an agreement entered into through the medium of the Platform, the Company may terminate the User’s membership, delete his/her profile and any content or information posted online by the User on the Platform and / or prohibit the User from using or accessing the Platform at any time in its sole discretion, with or without notice, including without limitation if the Company determines that the User is under the age of 18 years.
3. Your Account
If You wish to use the Platform, You are required to maintain an account and will be required to furnish certain information and details, including Your name, email id, contact number and any other information deemed necessary by the Company. You are responsible for maintaining the confidentiality and security of Your account, password, activities that occur in or through Your account and for restricting access to Your computer to prevent unauthorized access to Your account. You agree to accept responsibility for all activities that occur under Your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform Us immediately if You have any reason to believe that Your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner. Please ensure that the details You provide Us with are true, correct, accurate and complete. Upon SFPL gaining knowledge or having any reasonable suspicion that the information provided by You is wrong, inaccurate or incorrect, SFPL shall immediately terminate Your account without any notice to You in this regard. In the event of any changes to the information shared by You at the time of registering on the Platform, You shall be responsible for forthwith notifying the said changes to Us. You can access and update most of the information You provided Us on the ‘my account’ area of Your account after You log-in or by writing to Us at support@summup.in The right to use this Platform is personal to the User and is not transferable to any other person or entity.
4. Privacy
SFPL collects certain information from You in order to provide the Services. SFPL’s use of Your personal information is governed in accordance with the Privacy Policy which can be accessed at https://suprb.in/privacy_policy. For the provision of the Services, SFPL will be using and sharing the information of the User with multiple Lending Partners and other parties including technology service providers and CICs, as may be required for the purpose mentioned above and SFPL shall also run multiple checks, if applicable, to be able to get the best available offers to suit the needs of the Users. The collection, storing, use and transfer of information shared by You shall be governed in accordance with the Privacy Policy. Please read and understand the terms of the Privacy Policy prior to sharing any information with Us.
You confirm that all information given to SFPL (whether in Platform’s online form or otherwise) is true, correct and not misleading. You agree to provide any additional documents to the Company as may be required from time to time.
5. License and Site Access
The name of the Company, its logo and trademark and the rights in the Platform are exclusively owned by the Company. All rights relating to the Platform as well as its functionalities are the exclusive property of the Company (particularly including but not limited to copyrights, trademarks, source code, patents as well as any other intellectual property right therein). All the information provided on or via the Platform (including all texts, graphics, design or logos) shall be the intellectual property of the Company and or its affiliates.
SFPL grants You a limited, revocable, personal, non-assignable license to access and use the Platform solely for the purpose of availing the Services, but not to download any material from it (other than page caching) or modify it, or any portion of it. Any unauthorized access to the Platform or any networks, servers or computer systems connected to the Platform and any attempt to modify, adapt, translate or reverse engineer any part of the Platform or re-format or frame any portion of the pages of the Platform is not permitted. This license is non-transferable and does not permit any resale or commercial use of this Platform or its contents; any downloading or copying of account information for the benefit of anyone other than Your authorized use; or any use of data mining, robots, or similar data gathering and extraction tools.
This Platform or any portion of this Platform (including but not limited to any copyrighted material, trademarks, or other proprietary information) may not be reproduced, duplicated, copied, sold, resold, visited, distributed or otherwise exploited for any commercial purpose. Any unauthorized use of the Platform shall terminate the permission or revoke the license granted by the Company.
SFPL shall, at all times, have the right to monitor Your activities on Your account and Platform and shall have the right to terminate Your account and the Services in the event of any unauthorized use. The monitoring of the Platform is important to determine the veracity of the information provided by You and that every User remains in consonance with the terms provided herein. Subject to the terms mentioned herein, the Company shall also have the liberty to remove any objectionable content which is in contravention of these Terms & Conditions or share such information with any governmental authority as per procedures laid down by the law for the time being in force in India.
6. Service Termination
SFPL reserves the right to terminate the Services and Your use of the Platform at any time without giving notice of termination to You and without any liability towards you. Upon termination, (a) the rights and licenses granted to You in these Terms & Conditions will terminate; and (b) User must stop using the Platform.
7. Indemnity and Limitation of Liability
Notwithstanding anything to the contrary contained under these Terms & Conditions, neither the Company nor its affiliated companies, subsidiaries, shareholders, officers, directors, employees or any related party shall have any liability to You or to any third party for any direct, indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or relating to these Terms & Conditions or from Your use of the Platform and Services.
To the maximum extent permitted by law, You waive, release, discharge and hold harmless SFPL, its affiliated and subsidiary companies, and each of its shareholders, contractors, directors, officers, employees, and agents, third party associates, licensors, and any partners or Lending Partners from any and all claims, losses, damages, liabilities, cost, expenses and causes, including without limitation legal fees and expenses, arising out of Your use or misuse of the Platform, any violation by You of these Terms & Conditions, or any breach of the representations, warranties, and covenants made by You during the creation of Your account or Your infringement of any intellectual property or other right of any person or entity, or as a result of any threatening, libelous, obscene, harassing or offensive material posted/ transmitted by You on the Platform. SFPL reserves the right, at Your expense, to assume the exclusive defence and control of any matter for which You are required to indemnify SFPL, including rights to settle, and You agree to cooperate with SFPL’s defense and settlement of these claims.
The Company will use reasonable efforts to notify You of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive any termination of Your use of the Platform.
8. Disclaimer
SFPL does not make any representations or warranties on behalf of the Lending Partners, any financial service providers or insurance companies, partnered with SFPL with respect to the financial products provided by such partners on the Platform. SFPL shall be responsible only to the extent of providing the Services as a facilitator and all liabilities and obligations with respect to the financial products provided by the Lending Partners of SFPL shall be governed by the separate agreement / terms and conditions applicable between such Lending Partners and the Users. No advice or information, whether oral or written, obtained by You through the Platform will constitute or create any representation or warranty not expressly stated herein.
SFPL makes no representations or warranties about the accuracy, reliability, completeness, current-ness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Platform, non – infringement of proprietary rights or that the operation of the Platform will be error free and/or uninterrupted or that the error will be rectified. The Service, Platform and any data, information, third party software, reference sites, services, or software made available in conjunction with or through the Website is provided on an "as is" and "as available" basis.
SFPL expressly disclaims all warranties of any kind as to the Service and all information, products and other content (including that of third parties) included in or accessible from the Service, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose.
Further, SFPL makes no warranties that:
You are solely responsible for any damage to Your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by You from SFPL through or from the Service will create any warranty not expressly stated in these Terms & Conditions. This limitation of liability clause shall prevail over any conflicting or inconsistent provision contained in any of the documents / content comprising this Terms & Conditions. It is up to You to take precautions to ensure that whatever You select for Your use is free of such items as viruses, worms, malware, Trojan horses and other items of a destructive nature.
You acknowledge and agree You have entered into these Terms & Conditions in reliance upon the Disclaimers and the Limitations of Liability set forth herein, that the Disclaimers and the Limitations of Liability set forth herein reflect a reasonable and fair allocation of risk between You and Company, and that the Disclaimers and the Limitations of Liability set forth herein form an essential basis of the bargain between You and Company. The Company would not be able to provide the Platform to You on an economically reasonable basis without these limitations.
We may also facilitate funds transfer between You and the Lending Partners. We do not accept responsibility for any amounts transferred from or to Your bank account or any remittance failures. However, We shall undertake all reasonable steps to ensure such actions do not take place.
In the event that any of the exclusion contained in these Terms & Conditions is held to be invalid for any reason as per the applicable laws and We or any of our affiliates, officers, directors or employees become liable for loss or damage, then, any such liability shall be limited to the amount of the product purchased by You.
The Company does not in any manner guarantee, represent and/or warrant the totality, accuracy, adequacy and/or completeness of the credit health reports availed by You and/or any information and/or material contained therein and expressly disclaims any liability for any errors and/or omissions in this report and/or any information and/or material therein. This information should not be considered as advice or opinion, whether legal, financial or otherwise. Such advice must be specific to the various circumstances of each User, and the general information provided on these pages should not be used as a substitute by You for the advice of competent advisor including any legal and/or financial advisor/counsel. The Company shall not be liable for any loss, cost, damage and/or consequence as a result of reliance by You or any other person, with or without User’s knowledge, on the User’s credit health report or any information and/or material contained therein. You understand that, the credit health reports is fetched from the CICs based on Your explicit consent provided under the Privacy Policy, and the provision of insights by Us, as well as any information contained therein, should not be considered as an advice or opinion, whether legal, financial or otherwise. You understand that Our provision of insights on the credit health reports is a value added Service we offer and failure to pay the subscription fees will result in the immediate termination of Your paid Services by SFPL

The Company accepts no responsibility for advertisements contained within the Platform. SFPL has no control over and accepts no responsibility for the content of any third - party website or mobile application to which a link on the Platform exists. Such linked websites and mobile applications are provided “as is” for User’s convenience only with no warranty, express or implied, for the information or products and services provided therein. SFPL does not provide any endorsement or recommendation of any third party website or mobile application to which the Platform provides a link, You are requested to verify the said third party sources independently and at Your own risk. The Company further does not assume any liability towards the actions or omissions of the operators or owners of such external links or websites.
Your use of the said Third Party websites and links may be subject to additional terms and conditions and privacy policy of such third parties. You are advised to review the same before commencing any such usage of third-party services and products.
11. Acknowledgements
You acknowledge that SFPL is solely engaged in providing technological and analytical services relating to facilitation of financial services to the Users through regulated Lending Partners. The Company is not engaged in either grant of loan / insurance or any other financial products. You acknowledge that the use of the financial products is entirely based on the negotiations between You and the Lending Partners, and the Company or its affiliates, subsidiaries, shareholders, contractors, employees, officers, directors, agents and its third party associates or licensors do not have any liabilities with respect to any financial products or assistance procured or intended to be procured by a User. You acknowledge that SFPL will not be responsible for any claim or damage in case of use of the financial products by You. SFPL in no manner warrants or guarantees the performance of a service provider/Lending Partner that is offering the various financial products or services on the Platform.
You understand and acknowledge that provision of User’s credit health reports is a paid Service, for which the Company may charge such subscription fee, as notified on the Platform from time to time and also agreed to by You, by way of additional terms specific to the paid Services.
12. Governing Laws
Your use of the Platform and the terms contained herein, including the Privacy Policy, is governed by the laws of India. Courts of Gurgaon shall have the exclusive jurisdiction to resolve any disputes that arise pursuant to Your use of the Platform.
